Welcome to CSurgeries Surgeon Profile

Welcome to CSurgeries (“CSurgeries,” “we,” or “us”) and to the CSurgeries Surgeon Profile portal (the “Portal”). CSurgeries operates a peer-reviewed surgical video platform and professional profile listing designed to help surgeons connect, share expertise, and maintain accurate public profiles for educational and networking purposes.

When surgeons provide accurate, complete, and updated information to us, we are able to present more accurate and complete information to other professionals and the broader surgical community. This allows potential collaborators, trainees, and other healthcare professionals to make informed decisions when connecting with or learning from you.

Within this Portal, you may provide accurate, complete, and current information about yourself and your practice, including without limitation professional credentials, affiliations, photos, videos, and other relevant content (“Physician-Provided Material”). This Agreement governs your use of the Portal for the purpose of claiming and managing your profile.

1. Overview

This Surgeon Profile User Agreement (“Agreement”), as updated from time to time, governs:

Your access to and use of the Portal and related services;

Your submission of any and all Physician-Provided Material; and

Your receipt of communications from CSurgeries regarding your profile and our services.

By clicking “I Agree,” or by using the Portal, you, on behalf of yourself or your practice/entity, acknowledge and confirm that:

(A) You have read and understand all terms of this Agreement;

(B) You are the surgeon identified in the profile being claimed, or have express authorization from that surgeon;

(C) You agree to be bound by all terms and conditions herein; and

(D) If acting on behalf of a practice or entity, you have authority to bind that entity to this Agreement.

(E) You consent to receive communications from CSurgeries—including verification requests, notifications, service updates, or information related to your professional profile—by email or other contact methods you provide.

If you do not agree, do not click “I Agree” and do not access or use the Portal.

2. Privacy Policy

Our Privacy Policy describes how we collect, use, and protect personal data. By agreeing to this Agreement, you also agree to our Privacy Policy, which is incorporated by reference.

3. No Endorsements or Referrals

CSurgeries does not recommend, endorse, or refer patients to any specific surgeon. Profile profiles are for informational and educational purposes only and are not a substitute for independent professional judgment.

4. Registration and Verification

To claim and manage your profile, you must:

Provide your full legal name, professional credentials, and identifying details (e.g., NPI number and issuing state);

If requested, provide additional verification such as hospital affiliation letters, government-issued ID, or academic faculty listing.

By registering, you represent that:

You are the surgeon identified in the claimed profile, or have express written authorization from that surgeon;

All information provided is accurate, complete, and current; and

You will promptly update your information as needed.

You are solely responsible for maintaining the confidentiality of your password and account credentials.

5. License to Use the Portal

Upon acceptance of this Agreement, CSurgeries grants you a revocable, non-exclusive, non-transferable, limited license to access and manage your profile listing solely for professional and educational purposes. All rights not expressly granted are reserved by CSurgeries.

6. Ownership

As between you and CSurgeries, all right, title, and interest in and to the Portal and any associated content are the property of CSurgeries or its licensors. You may not reproduce, distribute, or create derivative works from Portal content without prior written consent.

7. Your Information & License You Grant

By submitting Physician-Provided Material, you grant CSurgeries a perpetual, worldwide, royalty-free, unrestricted license to use, reproduce, display, distribute, and create derivative works of such material in connection with the CSurgeries Profile and related services. You warrant that:

You own or have rights to all submitted material;

Your submissions are accurate and lawful; and

Your material does not infringe on any third-party rights or violate applicable laws.

8. Prohibited Content

You may not submit material that is:

False, misleading, defamatory, or fraudulent;

In violation of any applicable law or regulation;

Discriminatory, harassing, or obscene;

Infringing on any copyright, trademark, or other IP right;

Promotional in nature without authorization; or

Otherwise objectionable as determined by CSurgeries in its sole discretion.

9. Intellectual Property Infringement

For copyright claims, follow the Digital Millennium Copyright Act procedures outlined in our DMCA Policy. For other IP violations, contact info@csurgeries.com with:

Identification of the infringed work;

Identification of the infringing material and its location; and

Your contact information and a good-faith statement of unauthorized use.

10. Term and Termination

This Agreement takes effect when you click “I Agree” or use the Portal. CSurgeries may suspend or terminate your access at any time for violation of this Agreement or for any other reason.

11. Confidentiality & Security

While CSurgeries implements security measures, the confidentiality of data transmitted over the Internet cannot be guaranteed. You are responsible for safeguarding your credentials.

12. Monitoring

CSurgeries reserves the right to monitor and review Portal activity and to remove any Physician-Provided Material that violates this Agreement.

13. Events Beyond Our Control

We are not liable for service interruptions or damages caused by events outside our reasonable control, including but not limited to technical failures, natural disasters, or governmental actions.

14. Disclaimers

The Portal is provided “as is” without warranties of any kind. CSurgeries does not guarantee uninterrupted or error-free service, or that the Portal will meet your expectations.

15. Limitation of Liability

To the fullest extent permitted by law, CSurgeries will not be liable for indirect, incidental, or consequential damages arising from use of the Portal.

16. Indemnification

You agree to indemnify and hold harmless CSurgeries from any claims, damages, or expenses arising out of your use of the Portal or breach of this Agreement.

17. Class Action Waiver

You and CSurgeries agree that disputes will only be resolved on an individual basis and not as part of a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations are not permitted.

18. Governing Law & Venue

This Agreement will be governed by the laws of the State of Arkansas, without regard to its
conflict of law principles. Any dispute will be resolved exclusively in the state or federal courts located in Arkansas.

20. Miscellaneous

This Agreement constitutes the entire agreement between you and CSurgeries regarding the Portal. If any provision is deemed unenforceable, the remainder will remain in effect. Failure to enforce any provision will not be deemed a waiver.
